The principal claim defended in this thesis is that for Aristotle arousing the emotions of others can amount to giving them proper grounds for conviction, and hence a skill in doing so is properly part of an expertise in rhetoric. We set out Aristotle’s view of rhetoric as exercised solely in the provision of proper grounds for conviction and show how he defends this controversial view by appeal to a more widely shared and plausible view of rhetoric’s role in the (...) proper functioning of the state. We then explore in more detail what normative standards must be met for something to qualify as “proper grounds for conviction”, applying this to all three of Aristotle’s kinds of “technical proofs”. In the case of emotion, meeting these standards is a matter of arousing emotions that constitute the reasonable acceptance of premises in arguments that count in favour of the speaker’s conclusion. We then seek to show that Aristotle’s view of the emotions is compatible with this role. This involves opposing the view that in Rhetoric I.1 Aristotle rejects any role for emotion-arousal in rhetoric. It also requires rejecting the view of Rhetoric II.2-11 on which, for Aristotle, the distinctive outlook involved in emotions is merely how things “appear” to the subject. (shrink)

Although there is great concern about protecting those who participate in research, little if any concern has been expressed in the literature about protecting “decliners”—individuals who were invited to participate, but did not. However, there are several situations in which potential participants may experience negative consequences if they choose not to participate—for example, the prison setting, where the power imbalance is obvious and the history of research is not a positive one. Purpose The search for cause of death is important to improve knowledge and provide answers for the relatives of the deceased. Medical autopsy following unexplained death in hospital is one way to identify cause of death but is difficult to carry out routinely. Post mortem sampling (PMS) of tissues via thin biopsy needle or ‘mini incisions’ in the skin may be a useful alternative. A study was undertaken to assess how this approach is perceived by intensive care doctors and also (...) to evaluate how this practice is considered in ethical terms in France. Methods A study of PMS practices immediately after death in 10 intensive care departments was performed. The medical director of each centre was interviewed by telephone and asked to describe practices in their unit and to outline the questions raised by this practice. Results PMS is routinely performed in 70% of the units which responded, without systematically obtaining formal consent and without precise rules for communicating results. Approaches to PMS differed between centres, but all physicians felt that PMS is useful for the scientific information it gives and also for the information it provides for relatives. All physicians regret the lack of standards to structure PMS practices. Conclusion Information from post mortem examinations is important for society to inform about causes of death, for doctors to improve practices and for decision-makers responsible for organising care. Debate persists regarding the balance between individual rights and community interests. It is suggested that an approach for identifying cause of death could easily be integrated into the relationship between carers and relatives, provided full transparency is maintained. (shrink)

Mental health surveys are used extensively in epidemiological research worldwide. The ethical questions that arise regarding their risk of causing psychological distress or other potential harm have not been studied in the general population. We have investigated how study participants serving as controls in a population-based study perceived an anonymous postal questionnaire focusing on mental health and wellbeing. Parents were contacted from the Swedish Census Bureau as part of a larger follow-up study on palliative care conducted in 2001. Eligible parents (...) had a child of the same gender, year of birth and were from the same counties in Sweden as parents who had lost a child to cancer. Five percent reported being negatively affected. The principle negative effect on participants was that self-reflection reminded them of their difficulties. Of the 418 respondents, 52% reported that they were positively affected by study participation and 95% perceived the inquiry as valuable. These findings support the use of population-based controls in future research. (shrink)
